A long discredited, arcane 150-year-old law is back in the news in 2024, and that should terrify anyone who supports reproductive freedom. Anti-abortion activists like to bring up the Comstock Act because one of its clauses prohibits sending through the mail “every article, instrument, substance, drug, medicine or thing” that could possibly lead to an abortion. That could effectively make abortion impossible to access even in places like Minnesota, which has affirmatively protected a woman’s right to choose by passing reproductive freedom laws. In response, I’m prepared to fight back — including by introducing legislation to take away the Comstock Act as a tool to limit reproductive freedom. The Comstock Act hasn’t been broadly enforced since the 1930s.

The Comstock Act, as the law is known, is not central to the current Supreme Court case. Their interest in the law’s relevance to Tuesday’s case speaks to how the Comstock Act has taken a more prominent role in the efforts to further limit abortion. Among other arguments, the case’s plaintiffs, anti-abortion doctors and medical associations, have invoked the Comstock Act to argue the FDA acted unlawfully by not considering the 19th century criminal prohibition on mailing abortion drugs. But much attention will be paid to any commentary about the statute, even if just in a dissent, when the Supreme Court issues its ruling in the case in the coming months. Trump and officials who served in his administration are planning ways to restrict abortion rights if he returns to power that would go far beyond proposals for a national ban or the laws enacted in conservative states across the country. Behind the scenes, specific anti-abortion plans being proposed by Mr. Trump’s allies are sweeping and legally sophisticated. Some of their proposals would rely on enforcing the Comstock Act, a long-dormant law from 1873, to criminalize the shipping of any materials used in an abortion — including abortion pills, which account for the majority of abortions in America. “We don’t need a federal ban when we have Comstock on the books,” said Jonathan F. Mitchell, the legal force behind a 2021 Texas law that found a way to effectively ban abortion in the state before Roe v. (AP) — Former Virginia House Speaker Eileen Filler-Corn has decided against a bid for governor in 2025 and will instead run next year to represent the competitive northern Virginia congressional seat being vacated by a fellow Democrat, U.S. Rep. Jennifer Wexton. “This is an unfair, devastating reality that she now has to navigate,” Filler-Corn said, adding that she had discussed her plans with Wexton. The open seat dynamic in the Loudoun County-centered 10th District — Filler-Corn said she lives just outside it — could set up a competitive race with implications for party control of the U.S. House. Filler-Corn is a strong fundraiser who led the Democratic House caucus during the national scandal and party strife that exploded after the 2019 discovery of a racist photo in former Gov. FALLS CHURCH, Va. (AP) — U.S. Rep. Jennifer Wexton, a Democrat, announced Monday she won't seek reelection in her competitive district in the northern Virginia suburbs of Washington after learning she has a severe form of Parkinson's disease. Wexton announced in April that she had been diagnosed with Parkinson's and that she planned to continue her work in Congress. Wexton was a prosecutor and state legislator before she was elected to Congress in 2018. Virginia's 10th Congressional District, where Wexton serves, is centered in Loudoun County, an outer suburb of the nation's capital. Early symptoms of this disease are subtle and occur gradually, according to the National Institute on Aging.

As the legal battle over abortion pills winds through the federal courts, anti-abortion activists are citing a 150-year-old law, the Comstock Act of 1873, to bolster their case. Here is how the Comstock Act came to be and how it is being viewed today. What does the Comstock Act say? Among other things, the Comstock Act prohibits the mailing of “obscene, lewd, or lascivious” materials, like pornography, or any article or thing “intended for the prevention of conception or procuring of abortion.” It also prohibits shipping those things by way of express common carriers, meaning services like FedEx or UPS. The act’s namesake, Anthony Comstock, was a deeply religious Civil War veteran turned anti-vice crusader from New York who was obsessed with combating what he saw as a culture of sexual impurity.
